Who are we?
We are Alisa Creative LLC (Alisa Creative), a company registered in Bulgaria, Europe. The company is registered under UIC (unified identification code) 206434265.  Alisa Creative is the administrator of www.alisatextile.com (the Website). 

What is this?
This page provides information about our Terms of Sale. These Terms govern the relationship between us - Alisa Creative, and you - our Website’s visitors who purchase products via our online store. These Terms shall apply to all purchase contracts concluded between us and any consumers. “Consumer” means any natural person who is acting for purposes that are outside that person's trade, business, craft or profession. 

What should you do?
Please read these T&Cs carefully before using our website and before placing a purchase order! Please note that before placing an order or making a payment you will be asked to agree to these T&Cs. If you refuse to accept these Terms, you will not be able to order any products or make any payments.

Order and payment
You are welcome to place an order without having to create a user account. No sign-up or login is required to order. By submitting your order you agree to pay for the products you have selected. Please note that the product prices do not include shipping costs (where applicable) - they are being calculated during checkout depending on the delivery address. 

All orders are subject to our acceptance. We reserve the right to reject orders at our sole discretion, including if certain products become unavailable or if we do not offer delivery services to your shipping address. When we accept your order, you will receive an acknowledgement e-mail confirming the receipt.

We use the payment processing services of a third party. Currently, we are using the services of Stripe (Stripe Payments Europe Limited) and PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A.). The payment processing is regulated according to the applicable agreements, general conditions and privacy policies of the provider of this service and/or the issuer of your bank card, and we are not responsible in the event of errors and/or additional fee charges. Online payment transactions are also subject to validation checks by your card issuer and we are not responsible if the payment for your order is not authorized.

Shipment and delivery
Once we process and ship your order you will receive a tracking number. Your products will be delivered to the shipping address indicated in your order. We will make all reasonable efforts to fulfill your order by the estimated delivery according to our Shipping Policy, but we shall not be responsible for any delays caused by force majeure events or other circumstances outside our reasonable control.

The ownership of the products is transferred to you upon receipt and after all due payment is received by Alisa Creative. Until full payment, the products remain our property. The risk of loss or damage is transferred to you when you (or a person designated by you other than the carrier) accept the products.

Returns and right of withdrawal
Once you receive the products, you have a period of 14 days to withdraw from the contract without giving us any reason and without incurring any costs (other than the return shipping costs). Please note that you should notify us before the expiry of the 14-day withdrawal period. In order to exercise your right of withdrawal by an unequivocal statement, you can simply contact us via email or phone.
In the event of withdrawal, you shall send us back the products without undue delay and in any event not later than 14 days from the day on which you have communicated your decision to withdraw from the contract.

We will reimburse all payments received from you, including the costs of initial delivery without undue delay and in any event not later than 14 days from the day on which we are informed of your decision.

Please be careful and keep in mind that:

* Returns are only possible if you return the products in or with their original packaging and the products have not been used and are not damaged.
* You are liable for any diminished value resulting from the handling of the products other than what is necessary to establish the nature and characteristics of the products.

If you return products that are damaged or used in a way that significantly reduces their value, we reserve the right to reduce the refund amount. Completely unusable products are not accepted.

We don't offer exchanges. If you decide you like another one of our products better, please return your unwanted item and place a new order. 

Guarantee
The products you receive may vary slightly from the photographs on the website for technical reasons, such as your screen’s display capabilities, or due to the pattern of the fabrics and/or some minor modifications to the design. However, we are responsible for the quality and suitability of the products in their intended use. All products come with a 2-year guarantee from the date of delivery. If the delivered products are defective, you are entitled to statutory warranty claims. If you are not satisfied with the quality of our products, you can contact us and make a claim under the following conditions: 1) the claim must not be the result of incorrect maintenance of the product and disregard of indicated care instructions; 2) the reason for the claim must not be the result of normal wear and tear, discoloration due to sunlight exposure, moisture damage etc.
If we determine that the claim is covered by the guarantee, we will attempt to repair the product at our expense. If impossible or unrealistic, we will try to replace the product with another product. If we are unable to repair or replace the product you will be entitled to a refund.

Amendments
We may amend these Terms of Sale at any time and without prior notice. We will publish the updated Terms of Sale in a visible and easily accessible manner. The amended Terms shall be effective as of the date of publication on the Website unless explicitly stated otherwise.

Legal disputes
If something goes wrong, we accept to communicate in a manner of good faith. Any legal dispute or claim shall be decided upon negotiations and the goodwill of each party concerned.
However, if it is not possible to reach a mutual agreement any disputes shall be decided by the competent court of law that has the jurisdiction to do so. In case of a private law dispute with an international element the court that shall have jurisdiction to decide must be determined by the rules of Private International Law. The applicable law to the present agreement shall be the one of the State where you, as a consumer, have your habitual residence. 

 

Nothing in these Terms of Sale affects your legal rights under the applicable consumer protection laws.
